Terms of Use

These Terms of Use ("Terms") govern access to and use of the Oddsprey website and services (the "Service"), operated from the Netherlands ("Oddsprey", "we", "us" or "our"). By creating an account or otherwise using the Service, you ("you" or the "User") accept these Terms in full. If you do not accept them, you must not use the Service.

1. Eligibility and account

1.1 You must be at least 18 years of age and must have the legal capacity to enter into a binding agreement. By using the Service you represent and warrant that you meet these requirements.

1.2 You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account. You agree to provide accurate and complete registration information and to keep it current.

1.3 You must notify us promptly of any unauthorised use of your account or any other breach of security of which you become aware.

2. Nature of the Service

2.1 Oddsprey provides statistical football predictions and analysis generated by a statistical model together with an AI analyst that weighs recent form and publicly available news. The Service is provided for informational purposes only and does not constitute betting, financial, investment, legal or tax advice.

2.2 Oddsprey is not a bookmaker, betting operator or tipster service. We do not accept, place, broker or settle bets, and we do not offer any facility to gamble.

2.3 No prediction is certain. Predictions are estimates that may prove inaccurate, and past performance is not indicative of future results. Any decision to place a bet with a third party is taken by you alone, at your sole discretion and risk.

3. Responsible gambling

3.1 Gambling carries a risk of financial loss and may be harmful. You should wager only amounts you can afford to lose, set your own limits, avoid chasing losses and never treat gambling as a source of income.

4. Subscriptions, pricing and payment

4.1 Full predictions and analysis are made available through a paid subscription, offered on a monthly or annual basis. Each new account includes a one-month free trial with full access. An active subscription unlocks all fixtures for the duration of the subscription period.

4.2 Payments are processed by Stripe. The price displayed at the point of checkout applies, including any promotional discount shown there. A promotional discount applies to the first billing period only; the subscription renews at the standard price unless cancelled. New accounts receive a free trial and no payment instrument is required to start one.

4.3 Cancellation. You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of the paid period then in progress, during which you retain full access; the subscription will not renew thereafter. We do not provide pro-rata refunds for the unused portion of a paid period.

4.4 Right of withdrawal. Where you are a consumer resident in the European Union, you have a period of 14 days within which to withdraw from a new paid subscription without giving reasons. Because the subscription provides immediate access to digital content and services, if you request that performance begin during the withdrawal period you acknowledge that the right of withdrawal is lost once the service has been fully performed, or that you may be required to pay an amount proportionate to the service provided up to the point of withdrawal. Nothing in this clause limits any mandatory right you have under Dutch or European Union consumer law.

4.5 A subscription is granted for your personal use only. You may not share, sublicense, sell or otherwise transfer access to your account.

5. Acceptable use

5.1 You agree not to:

• use the Service for any unlawful purpose or in breach of any law applicable to you;
• resell, redistribute, publish or otherwise commercially exploit our predictions or analysis;
• scrape, harvest or access the Service by automated means without our prior written consent;
• attempt to disrupt, overload, reverse-engineer or gain unauthorised access to any part of our systems; or
• harass, abuse or threaten our personnel or other users.

5.2 We may suspend or terminate any account that we reasonably consider to be in breach of this clause.

6. Intellectual property

6.1 All predictions, analysis, text, graphics, logos, trademarks and software comprised in the Service are owned by us or our licensors and are protected by applicable intellectual property laws.

6.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable and revocable licence to access and use the Service for your own personal, non-commercial purposes. You may not copy, reproduce, redistribute or resell any part of the Service without our prior written consent.

7. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranty, express or implied, that the predictions will be accurate, reliable or profitable, or that the Service will be uninterrupted, secure or free from error. A separate Disclaimer forms part of these Terms.

8. Limitation of liability

8.1 To the fullest extent permitted by law, we shall not be liable for any gambling losses, for decisions taken by you in reliance on the Service, or for any indirect, incidental, special or consequential loss.

8.2 Where we are found liable notwithstanding the above, our aggregate liability shall not exceed the amount, if any, paid by you to us for your subscription in the 30 days preceding the event giving rise to the liability.

8.3 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Dutch law, including liability for fraud or for death or personal injury caused by our negligence. Your mandatory rights as a consumer are not affected.

9. Suspension and termination

We may suspend or terminate your account where you are in breach of these Terms, where we detect fraud or abuse, or where required by law. You may close your account at any time from your account page. Provisions which by their nature should survive termination (including clauses 6, 7, 8 and 10) shall continue to apply.

10. Governing law and disputes

10.1 These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent court in the Netherlands, save where mandatory consumer rules entitle you to bring proceedings in another forum.

10.2 Consumers resident in the European Union may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

11. Amendments

We may amend these Terms from time to time. The date stated above indicates the current version, and we will draw attention to material changes on the Service. Your continued use of the Service after an amendment takes effect constitutes acceptance of the amended Terms.
